How To Start The Divorce Process

Keep in mind that the exact way to start the divorce process varies depending on the state you are filing in. You will have to learn the requirements that are outlined by your state before starting. However, they are pretty similar across the board in the United States. You will have to decide where you want to file. If you or your spouse has established residence in a state for at least 6 months (or a year), then the chances are good that you can file there. The process officially begins with the Original Petition for Divorce.

Once filled out, this document then is submitted to the court clerk in your area. It’s simply states that you are requesting a divorce and asking the court for approval. It also includes details such as the identity of your spouse, children (if applicable), and the primary reason for the request.

The petition is then served to the other spouse, who then becomes the “respondent” while the person initiating the divorce is the “petitioner.” The respondent then has 30 days to give a reply. Should the respondent agree to what’s outlined in the petition, then there is a better than average chance that the divorce can proceed without going to court.

Should your divorce be uncontested, here are some excellent resources to start the process:

Legal Zoom

Legal Zoom has a 3-step process put together by highly reputable law firms throughout the United States. First, they tell you based on a questionnaire whether or not you qualify for an uncontested divorce.

Next, you fill out another questionnaire related to the details of your divorce. Lastly, the divorce papers are created and will be sent to you in 5-7 days. Instructions are included to help you know what to do next. This is one of the most popular divorce services online.

Find Legal Forms

FindLegalForms.com provides all possible divorce forms and agreements used in divorce cases. You can purchase documents individually, or buy everything you need in a combo package for a very low price. They can be downloads straight to your computer. All you have to do is select the state and whether you have children or not. Before you buy, all the forms included in the package are listed.

3 Step Divorce

3StepDivorce.com gives you all the necessary paperwork in one hour or less by following three steps. First, you sign up for an account. In the next step, you answer questions about your divorce so they know which paperwork you need, based on state you’re filing in, debt, property, and other personal details. Once that occurs, they will provide you with all the documents and instructions you need.

      Hi Jessica

I would contact the the legal aid again, or look for another service in your area. You could try the bar association, as they sometimes provide pro bono divorce lawyers. You can also look for Federally funded programs, as they offer services to low income people.

Have you tried working things out with him? The cheapest way to get divorce is to settle the issues with your spouse. I don’t know all the details of your relationship, so that may or may not even be an option.

Mediation is also very inexpensive, as you and your spouse settle with the help of a third party.

      I hope this helps
